Overview

The Natural Hazards Insurance Act 2023 (the NHI Act) which commences on 1 July 2024 will replace the
Earthquake Commission Act 1993. It sets out several new requirements for Toka Tū Ake. This includes the
obligation to improve the customer experience for insured persons by, amongst other things, providing a clear
process for claim related disputes (Dispute Resolution Scheme).
We are looking for one or two providers that have the necessary skills, experience, and capacity to deliver
dispute resolution services as an approved scheme under the NHI Act and are willing to work with us to refine
the draft rules for the scheme (the Draft Scheme Rules) prior to and including any amendments through the
public consultation. We will be responsible for finalising the Draft Scheme Rules, at which point, they will be
the Scheme Rules.
This process is being used as a mechanism for which the Buyer will make a recommendation to the Minister
Responsible for the Earthquake Commission, and in no way guarantees the appointment of a Respondent.
Any potential execution of an appointment is subject to approval from the Minister responsible for the
Earthquake Commission/Natural Hazards Commission.
